KYIV, UKRAINE – Lots of people wondered after the second semi final in Ukraine last Saturday why Sunsay entry was allowed to participate in the national selection as the song was already on YouTube since 2014.
The song is uploaded on YouTube as part of a club gig of the band in 2015 and in concert in 2014. Though the Ukrainian national broadcaster is about to do everything possible to save the entry.
The winner of the second semi final is about to be saved by NTU as the director general seems to have stated that the rules (without clarifying if he talks about the Eurovision or national selection rules) are flexible, claiming that the performance was not in a concert but in a club.
National selection rules clearly state that: the song must be original (created without the use of any other works, without violating the rights of third parties), it has not been publicly presented in full or in part (including the text separately from music or vice versa), and was not used in any way for commercial purposes prior to 1 September 2015.
It is also mentioned on the web that the gig in Moscow was not a club but a concert hall as Izvestia Hall is officially described.
The band performances in Russia and Crimea though might also cost them their participation especially in these turmoil times.
